Gold & Cherry offers a 1-Year Limited Warranty on all Gold & Cherry products on the terms and conditions set out below. If you purchased the product on www.goldandcherry.com you are covered by this warranty.

Policy coverage

Defects in materials and workmanship under normal use. Only original, unaltered, and unmodified materials and workmanship are covered by this warranty.

Exclusions

Damages caused by operating the product outside its intended use, corrosion, broken or lost/stolen products. The warranty is 1-year after purchase of your device for device-specific products.

Remedy – At Gold & Cherry's sole discretion

Attempt remote troubleshooting and offer a discounted replacement unit if failed to fix the issue.

WARRANTY

These warranty terms cover all Gold & Cherry-branded products. All Gold & Cherry warranties are non-transferrable and are only available to the original end-user of the product. Warranties do not apply to products purchased from online vendors unauthorized to sell Gold & Cherry -branded products, including other marketplaces.

1-YEAR LIMITED WARRANTY

Gold & Cherry warrants all Gold & Cherry products against electronics defects under normal use for one (1) year from the date of purchase by the original purchaser.
This warranty does not apply to normal wear and tear including failed/broken items, bands, hinges, Keys, batteries etcetera.

GENERAL TERMS

This Gold & Cherry warranty is a voluntary manufacturer’s warranty. It provides rights separate from rights provided by consumer law in your country of residence. As such, these warranty benefits are in addition to, and not instead of, rights provided by consumer law and it does not exclude, limit or suspend a buyer’s rights arising from consumer law. Consumers have the right to choose whether to claim service under this warranty or their consumer law rights. Please note that these warranty terms and conditions shall not apply to consumer law claims. Please contact your local consumer organization for more information on applicable consumer laws in your country. If any provision of these warranties is unlawful, void, or unenforceable, that provision shall be deemed severable and shall not affect any remaining provisions.

Your Gold & Cherry hardware product is warranted against defects in materials and workmanship under normal use when used by Gold & Cherry’s user manual that comes with the product and for the relevant Warranty Period (see above). Only original, unaltered, and unmodified materials and workmanship are covered by this warranty.

If a defect arises during the Warranty Period, Gold & Cherry, at its sole discretion and option, will exchange the product with a product of equivalent functionality and value. Due to the nature of the product, repair or identical replacement products or parts may not be available at the time of the claim (including where a product has been discontinued). Gold & Cherry shall replace a damaged part with the closest matching product or the closest matching part of the product in the closest matching color. This warranty shall be handled on a case-by-case basis between Gold & Cherry and the customer, and Gold & Cherry will have the final decision as to what resolution to offer. additional shipping costs of a replacement unit would be collected, as charged by the shipping carrier, from the customer side per Gold & Cherry carrier shipping rates.

This warranty excludes the normal depletion of consumable parts such as batteries. Any problem caused by abuse, accident, misuse, modifications, unauthorized repairs, exposure to excessive heat, liquids, sand, or other contaminants, or an act of God (such as but not limited to flood, drought, earthquake, or any other natural disaster) is not covered nor are other causes that are not defects in materials and workmanship. The Warranty does not cover the replacement of lost or stolen products.

Your Gold & Cherry product is only to be used with the corresponding device specified on the packaging/instructions. Gold & Cherry will not be responsible for any damage caused by use with a device/accessory (e.g., screen protector) other than the device/accessories approved and specified by Gold & Cherry on the packaging. Gold & Cherry disclaims all liability for any damage or malfunction caused to any separately purchased Apple® iPad or any other device, and shall not be responsible under any implied or expressed warranty or guarantee about any separately purchased Apple® iPad or any other device. For screen protectors, this warranty is automatically voided where the screen protector is removed from the original device to which it was attached.

Gold & Cherry reserves the right to reject any warranty claim where it detects foul play. Any product that has any physical damage, that is not in a clean and as new condition (such as scratches or dents or discoloration from dirt or other materials) or damage caused by liquid will void this warranty and any request not be approved for a warranty claim. For keyboard products, accidental damage, scratches, dings, dents, or any shifting or malfunction in the keys and or keyboard due to rough treatment or incorrect use of the keyboard is not covered and will void the warranty. 

Gold & Cherry's total liability under this warranty is limited, in all circumstances, to the value of the product purchased by the customer.

A replacement product assumes the remaining term of the warranty from the original date of purchase. Where a product is replaced, the replaced item becomes the property of Gold & Cherry and any replacement item becomes your property.

Gold & Cherry IS NOT RESPONSIBLE FOR DAMAGES RESULTING FROM ANY BREACH OF WARRANTY, INCLUDING BUT NOT LIMITED TO LOSS OF USE, LOSS OF DATA, LOSS OF REVENUE, AND LOSS OF ANTICIPATED PROFITS. Gold & Cherry’s WARRANTIES DO NOT COVER ANY THIRD-PARTY DEVICES OR THE PERSONAL PROPERTY OF ANY CONSUMER. THESE WARRANTIES DO NOT APPLY TO Gold & Cherry SOFTWARE OR ANY THIRD-PARTY SOFTWARE. ANY ALTERATION, CHANGE, MODIFICATION, OR REPAIR (OTHER THAN REPLACEMENT OF A REPLACEABLE COMPONENT) MADE TO THE PRODUCT BY A PARTY OTHER THAN Gold & Cherry OR Gold & Cherry’S AUTHORIZED SERVICE PROVIDERS VOIDS ALL WARRANTIES. Gold & Cherry RESERVES THE RIGHT TO REFUSE WARRANTY REPLACEMENT FOR SUSPECTED FRAUD OR ABUSE OF Gold & Cherry’S WARRANTY POLICY CONTAINED HEREIN. Gold & Cherry’S WARRANTIES AND REMEDIES SET FORTH ABOVE ARE EXCLUSIVE AND instead of ALL OTHER WARRANTIES, REMEDIES, AND CONDITIONS, WHETHER ORAL OR WRITTEN, EXPRESS OR IMPLIED. Gold & Cherry SPECIFICALLY DISCLAIMS ANY AND ALL IMPLIED WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. IF THE LAW PROHIBITS Gold & Cherry FROM DISCLAIMING IMPLIED WARRANTIES OR WARRANTIES OF MERCHANTABILITY, ALL SUCH WARRANTIES ARE LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW.

Gold & Cherry AUTHORISED RESELLERS, AGENTS OR EMPLOYEES ARE NOT AUTHORIZED TO MODIFY OR EXTEND Gold & Cherry'S WARRANTIES. Gold & Cherry RESERVES THE RIGHT TO CHANGE WARRANTY TERMS AND REMEDIES WITHOUT NOTICE.
